Difference between Criminal and Civil Cases
There is a certain and definite Difference between Criminal and Civil Cases.
Laws are made by the state for protection of Life and Property of its citizens. Every other citizen has to respect these laws. Whenever a person violates such protective Laws तो सरकार की तरफ से ऐसे रूल तोड़ने वाले के खिलाफ एक्शन लिया जाता है। यही एक्शन क्रिमिनल केस कहलाता है। सरकार ने अपनी सिविल ताकत को इस्तेमाल करने के लिए जिस फोर्स को बनाया है वह पुलिस कहलाती है।
तो जब भी कोई देश के उस कानून को तोड़ता है जो सभी के व्यवहार को नियंत्रित करता हो तो देश की सिविल फोर्स पुलिस एक्शन लेती है। उस नियम तोड़ने वाले के खिलाफ गिरफ्तारी, चालान या फाइन जैसे कदम उठाती है जिनकी परमिशन कानून से उस पुलिस फोर्स को मिली होती है। इसमें नियम भंग करने वाले को स्टेट के द्वारा दण्डित किया जाता है। जेल भी भेजा जा सकता है।
Such matters where you are found violating the Rule based conduct, the state agency Police takes action against you and another agency i.e., the Court takes steps that a proper penal action is taken against you.
लेकिन दूसरी ओर दो नागरिकों के बीच के लेन देन के मामले होते हैं। जिनके तहत वे आपसी रुपये पैसे, व्यपार, शादी ब्याह, मालिक किराएदार आदि के मसले निपटाते हैं। इसमें संबंधित पार्टियों के आपसी हित जुड़े होते हैं। तो इन संबंधित लोगों की भूमिका और उनके द्वारा किए गए कामों को देखते हुए कोर्ट उनके आपसी विवाद निपटाती है। ये सिविल मामले होते हैं।
इन आपसी Civil Cases में जिसकी गलती होती है उसे अपना कानूनी दायित्व सही से निर्वाह करने के लिए कहा जाता है। जिस पार्टी को नुकसान हो चुका होता है, नुकसान करने वाली पार्टी उसका हर्जाना देती है और क्षतिपूर्ति करती है।
Civil Cases में आमतौर से दण्ड की बजाय क्षतिपूर्ती का नियम अपनाया जाता है।
Civil and Criminal matters के कानून अलग अलग होते हैं और दिल्ली जैसे महानगरों में उनके लिए अलग अलग कोर्ट्स गठित की जाती हैं। अन्य प्रदेशों में एक ही कोर्ट एक साथ सिविल और क्रिमिनल मामलों को देखती हैं।
कुछ ऐसे नए कानून भी संसद ने बनाए हैं जिसमें जो घटनाक्रम सिविल मैटर के रूप में शुरू होता है और कोर्ट उसमें कोई व्यवस्था दे देती है तो उस व्यवस्था के उल्लंघन पर क्रिमिनल एक्शन शुरू हो जाता है। Domestic Violence Act 2006 के तहत् इसी तरह की व्यवस्था की गई है।
जब कोर्ट्स को लगता है कि किसी व्यक्ति को कुछ राहत दी जानी चाहिए तो क्रिमिनल कोर्ट उस व्यक्ति को गिरफ्तारी से बचने के लिए अग्रिम जमानत या Anticipatory Bail दे देती है और यदि उसे पहले ही गिरफ्तार कर लिया गया हो तो जमानत या Bail दे देती है।
इसी तरह सिविल मैटर्स में किसी व्यक्ति को आकस्मिक हानि रोकने के लिए या स्थितियों पर नियंत्रण पाने के लिए कोर्ट्स उचित व्यक्ति के पक्ष में स्टे या Injunction Orders पास करती हैं।
क्रिमिनल मामलों में Code of Criminal Procedure तथा India Penal code दो मुख्य कानून हैं जबकि सिविल मामलों में Civil Procedure Code तथा अन्य अनेक कानून हैं जैसे Contract Act, Transfer of Property Act, Laws on Tenancy, Sale of Goods Act, Partnership Act आदि होते हैं।
