When is Bail available
Bail commonly means release on one’s own bond, with or without sureties. Every accused person is presumed to be innocent until proved guilty. The effect of granting bail is not to set the accused free, but to release him from custody and to entrust him to his own bond and to the custody of his sureties who are bound to produce him to appear at his trial at a specified time and place. Thus, Bail is security obtained from a person arrested regarding an offence for the purpose of securing his presence during the course of a trial.
प्रसिद्ध केस State of Rajasthan vs. Balchand (AIR 1977 2447) में माननीय जस्टिस V. Krishna Aiyer व्यक्ति के Fundamental Rights की महत्ता को रेखांकित करते हुए कहा था कि ‘Bail is a rule, jail is an exception’. उनके इस कथन को एक लीगल डॉक्ट्रिन के रूप में देखा जाने लगा था।
सामान्यतः Bail का अर्थ है – release on one’s own bond, with or without sureties. Bond का मतलब होता है खुद का मुचलका, व Surety का अर्थ होता है जमानती। भारतीय न्याय शास्त्र कहता है कि जब तक किसी का गुनाह साबित ना हो जाए तब तक उसे निरपराध माना जाए।
इस तरह बेल पाने से कोई निरपराध होकर केस से मुक्त नहीं होता है बल्कि उसे न्यायालय की कस्टडी से जमानती की कस्टडी में कुछ आजादी से साथ दे दिया जाता है ताकि वह मुलजिम जब भी कोर्ट या पुलिस बुलाए तो वह आए और प्रक्रिया में अपने भागीदारी दे। Thus, Bail is security obtained from a person arrested regarding an offence for the purpose of securing his presence during the course of a trial or Investigation.
Section 436 CrPC यह परिभाषित करता है कि a person accused of a Bailable Offence under I.P.C. can be granted bail. अर्थात Bailable Offence में आप अधिकार पूर्वक बेल प्राप्त कर सकते हैं। पुलिस या कोर्ट आपको जबरदस्ती जेल नहीं भेजेंगे। आप बेल बॉण्ड दीजिए और आपको घर जाने दिया जाएगा।
दूसरी ओर Section 437 CrPC Non Bailable Offence में भी बेल दिए जाने की बात करता है। इसके तहत् सामान्यतः मजिस्ट्रेट साहेबान अपने बेल देने के अधिकार का प्रयोग करते हैं और ये अपेक्षाकृत छोटी श्रेणी के अपराध होते हैं। गम्भीर अपराधों के लिए Section 439 CrPC के अन्तर्गत सेशन्स कोर्ट और हाईकोर्ट दोनों को Non Bailable Offence में बेल देने का अधिकार है। कानूनी रूप से आप सीधे हाईकोर्ट में भी Section 439 CrPC के अन्तर्गत बेल माँग सकते हैं लेकिन परम्परा यही है कि हाईकोर्ट तभी बेल सुनना चाहते हैं जब सेशन्स कोर्ट उस बेल के बारे में अपना मत व्यक्त कर चुका हो। इसलिए Non Bailable Offence में पहले सेशन्स कोर्ट में बेल माँगनी अधिक उचित है और उसके बाद हाईकोर्ट के सामने बेल माँगी जा सकती है।
हालाँकि बेल कोर्ट्स अनेक बेल ऑर्डर्स में बहुत से सिद्धाँत सामने रखते हैं ताकि उनका पालन किया जा सके लेकिन वास्तविकता यह है कि बेल का अधिकार कोर्ट का विवेकाधिकार है। आमतौर से कोर्ट उन्हीं मामलों में बेल देते हैं जिनमें उनका विवेक ऐसा करने के लिए उन्हें कहता है।
In India, bails are regulated by the Criminal Procedure Code and can be broadly classified into 4 main types; they are: –
- Regular Bail: – Is a bail granted to a person who has been arrested and/or was in police custody or judicial custody.
- Anticipatory Bail: – Is bail granted before the arrest and is granted normally by Sessions Court or High Court. It is granted when someone apprehends arrest in some crime.
- Interim Bail: – Is a bail granted before the hearing for a grant of regular bail or anticipatory bail for a shorter span of time.
- Default bail: – Is granted as per Section 436A of the code of criminal procedure when the accused is under trial and is in judicial custody and has undergone half of the maximum punishment awardable for the offence.
