Is Law Sacred?
Is Law Sacred is a debatable issue. Arguments can be led on both side if the law is sacred.
A concept or thing is called sacred when everything else has a lower value compared to the sacred thing.
God and deities are considered as sacred.
Those who believe in God will value all other things inferior to the God and hence, they are likely to surrender all other things when a question of comparison between the God i.e., the Sacred one and the other things which are not sacred.
हिंदी में Sacred का अर्थ परम् पावन लिया जाता है।
लॉज़ में परम् पावन जैसा कुछ नहीं होता।
एक लॉ बनता है। काम करता है। जब यह पुराना हो जाता है तो इसके स्थान पर दूसरा बना दिया जाता है।
Objectives of the law
कानून का उद्देश्य (Objective of the Law) सुचारु व्यवस्था बनाए रखना होता है। इसके लिए जो एजेन्सियाँ कानून बनाने के लिए अधिकृत होती हैं वे नई स्थिति बनने पर तत्काल कानून बना देती हैं।
For Example:
When the Female Foetuses were destroyed during pregnancy the appropriate authorities made a law that prohibits the Pre-Natal Gender Determination.
The objective of this law was to protect the female children during pregnancy.
Can Laws be disputed?
Law making is a continuous process. Authorities लगातार कानून बनाती है। कई बार ऐसा होता है कि राज्य सरकारे केन्द्र सरकार के क्षेत्र में लॉज़ बना देती हैं या इसका उल्टा भी हो जाता है। कई बार सरकारें ऐसे लॉज़ बना देती हैं जो Constitution of India के अनुरूप नहीं होते। या सरकारें कानून बनाते समय अपने अधिकारों से बाहर जाकर कानून बना देती हैं।
In all such cases Laws can be disputed. These Laws are disputed before the Supreme Court of India. ऐसे कानूनों की व्याख्या का अधिकार Supreme Court के पास है। यदि इन लॉज़ में बताई गई खामियाँ पाइ जाती हैं तो इन लॉज़ को निरस्त कर दिया जाता है।
There is a complete history where the laws were repealed by the Supreme Court of India on the grounds of being defective or ultra vires of the Constitution of India.
इसी तरह कानूनों को Amend भी किया जाता है। इनके किसी एक भाग को सुधारा या बदला जाता है।
इस तरह यह बात स्पष्ट होती है कि लॉज़ एक मानवीय काम हैं। अन्य सभी कामों की तरह ये भी ठीक या गलत या सुधार के योग्य होते हैं।
केवल यह महत्वपूर्ण है कि इन कानूनों को सही गलत ठहराने और सुधार करने या बदल देने की शक्ति उन्हीं निकायों में होती हैं जो संविधान के अनुसार होते हैं।
संविधान के भी उन हिस्सों में बदलाव किए जा सकते हैं जो समय की कसौटी पर पुराने पड़ जाते हैं। भारत के संविधान में अब तक 104 बार बदलाव किए जा चुके हैं।
