You are Guilty by Accusation

Alan Dershowitz is an American lawyer known for his work in U.S. constitutional law and American criminal law. He taught at Harvard Law School from 1964 through 2013, where he was appointed as the Felix Frankfurter Professor of Law in 1993.

Beginning in late 2014, Giuffre began publicly accusing Dershowitz, now 81, that he sexually assaulted her during the time she was with Epstein her agent. By that time, the law of limitation in criminal cases had ceased to exist. Dershowitz started a campaign and denied Giuffre’s charges. He said “I can prove conclusively that she made the whole thing up.”

But everything is about balance. And in the wake of the movement came stories of men who were afraid of what might happen if they were falsely accused.

Lawyer Dershowitz said, “I welcome controversy about my ideas. I love having debates and controversy about my ideas. But having controversy about whether or not I’m a sex offender? That’s not what I bargained for in my life.”

He summarized his dilemma:

  • If you call a woman a liar, even if you didn’t do [what you’re being accused of], you’re guilty of calling a woman a liar, so there’s no way out.
  • If you call a woman a liar, even if you didn’t do [what you’re being accused of], you’re guilty of calling a woman a liar, so there’s no way out.
  • If you don’t deny it, you’re thought to be guilty.
  • If you do deny it, you’ve committed an additional political sin, so it’s a trap. And it feels just horrible…

Dershowitz described the challenges of facing sexual accusation. It included

  • the financial cost of fighting the accusation,
  • the embarrassment of having to tell every potential client of the claims while he is pursuing it in court,
  • the impact it has had on his family, including his grandchildren.

He said repeatedly, “It’s been terrible. No one who knows me believes it, none of my personal friends. But it has still had a terrible impact on my grandkids who are in school where people believe everything that’s said, and on my children. It’s had a terrible impact on us. I’m a victim, and no one wants to treat me like a victim.”

It is not only the trauma faced by a lawyer at an odd age. This reckless attitude of accusing anyone for sexual implication has become a trend. A few one takes it as a matter of pride if their name is among the accusers particularly after decades of the alleged harassment.

There is no need to give any evidence, no credibility is required nothing trustworthy is needed. The only requirement is a sensational accusation. Everything is done easily.

In India the influential ones are able to evade the consequences. The then Chief Justice of India Gogoi was accused of Sexual Harassment at Workplace but he chaired the proceedings of the Supreme Court of India and managed an escape root from the allegations. But others are not so fortunate. They have to face all adversities – social, financial, legal, emotional and all other *als.

The guardian has published Pew Centre Research Survey and the findings are quite alarming. Its astonishing facts are given below:

Back in April 2018 a majority of the respondents (55% men and 47% women) in a Pew Centre Research survey of 6,251 adults said that the movement has “made it harder for men to know how to interact with women in the workplace” and to “navigate workplace interactions”. Sadly, only 28% thought that the movement will lead to more opportunities for women.

And now we have a new study due to be published by the University of Houston, also with discouraging results. The study found that men are now “significantly more reluctant” to interact with their female employees. Among the findings, as reported by the Guardian’s Arwa Mahdawi, are that 27% of men avoid one-on-one meetings with female co-workers, 21% of men said they would be reluctant to hire women for a job that would require close interaction (such as business travel) and 19% of men would be reluctant to hire an attractive woman.
