Laws, Rules, Regulations and Circulars
Last time we tried to understand what the law is?
Now we try to understand what the Rules, Circulars and Notifications are in relation to a law.
Rules are understood in a two way manner.
When the word Rule is used as a genus. बहुत बड़े अर्थ में रूल का मतलब विधिपूर्वक होता है।
India always seeks a Rule-Based navigation system in the waters of South China Sea.
Although some Countries say that these waters belong to them and they will force their resolve in those waters.
यहाँ Rule-Based का मतलब कानून सम्मत है। कानून के अनुसार। जबरदस्ती के खिलाफ।
यह रूल का अर्थ हुआ।
In the second sense:
Rules provide for the working details of a law. Rules tell how a Law will achieve its objective.
हम इसे उदाहरण से समझते हैः
यदि व्यक्ति A किसी व्यक्ति B के विरुद्ध कोई शिकायत करना चाहता है तो यह सवाल उठेगा कि शिकायत किस अधिकारी के पास की जाए?
इसके लिए सरकार Rules बनाएगी कि कौन अधिकारी शिकायत प्राप्त कर सकेगा? तो रूल बनाया जाएगा कि Receipt Clerk शिकायत प्राप्त करेगा।
इसके बाद रूल का अधिक अर्थ स्पष्ट करने के लिए Regulations लाए जाते हैं। जैसे उपरोक्त उदाहरण में यह कहा जा सकता है कि Receipt Clerk की नियुक्ति होने तक थाने का Telephone Operator ही Receipt Clerk का काम करेगा।
Rules का आगे स्पष्टीकरण Regulations के द्वारा होता है।
Circulars उससे भी छोटे अधिकारिक संदेश होते है।
उपरोक्त उदाहरण में यह बताया जाए कि Constable Ravi इस तारीख से अगले दो महीने तक Telephone Operator cum Receipt Clerk का काम करेगा। तो यह सर्कुलर के द्वारा होगा।
Notification का अर्थ होता है कि उपरोक्त Law, Rule, Regulation, Circular आदि को सरकारी प्रकाशन के द्वारा संबंधित लोगों की जानकारी में लाना। इसमें सरकारी प्रकाशन इसलिए कहा गया है कि सरकार अपने प्रत्येक काम को एक Standardized Manner में करती है।
